Conveyancing Issues That Can Stall A Transaction

When buying or selling a property, everyone hopes for a smooth and straightforward process. But, that doesn’t always happen and there are many issues that can stall a transaction and make it take longer than is ideal.

Missing paperwork

From contracts to ID checks, there is a forest’s worth of paperwork involved in a conveyance, and when some element of it goes missing, delays are inevitable. Similarly, when people fail to reply to emails or fill in legal forms correctly, further delays can be caused.

Legal title issues

If property searches or other investigations reveal a problem with the property’s legal title, such as a boundary dispute, it can halt a sale and require additional work to resolve. While this isn’t the fault of the conveyancing firm, it can still cause significant delay and frustration for both buyers and sellers. Survey issues

While the vast majority of survey results are positive, there are occasionally things that aren’t, which can again halt a sale. The good news is that if the issue is something that could be resolved, such as an extension needing planning permission, or a repair that needs doing, a good conveyancer should point this out to both parties and help them find solutions.

However, if a legal company fails to communicate with its clients, acts aggressively or doesn’t abide by codes of conduct or law, it can be difficult to get the problem resolved. While it is possible to complain to the Legal Ombudsman, this can be a long and expensive process that isn’t always successful.
